NDTAC published an issue brief, "Key Considerations in Providing a Free Appropriate Public Education for Youth With Disabilities in Juvenile Justice Secure Care Facilities," which outlines key components within the IDEA necessary for providing FAPE to youth with disabilities in juvenile justice facilities. The brief describes the three key components as: (1) Child Find, including the “identification, location, and evaluation of eligible children and youth with disabilities”, (2) free appropriate public education, “in the least restrictive environment (education with peers who are nondisabled) to the maximum extent appropriate”, and (3) individualized education programs and “related protections, including parental participation.” Each section also provides suggestions for improvements that are based on many of the Guiding Principles for Providing High-Quality Education in Juvenile Secure Care Settings.
